Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Blue Sage platform, including the website at bluesage.app, the dashboard, APIs, chatbot widget, and related services (collectively, the “Service”) operated by Blue Sage (“we,” “our,” or “us”).

By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

1. The Service

Blue Sage is an AI-powered patient growth and retention platform designed for med spas and similar businesses. The Service provides automated message drafting, approval workflows, patient communication via SMS and email, lead capture via an embeddable chatbot widget, and analytics.

Blue Sage is not a medical device, does not provide medical advice, and is not a substitute for professional medical judgment. All AI-generated message content is subject to your review and approval before delivery to patients.

2. Accounts and Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You must notify us immediately if you become aware of any unauthorized use of your account. We are not liable for losses arising from unauthorized access to your account.

3. Your Responsibilities

By using the Service, you agree to:

  • Obtain proper consent: You are responsible for ensuring you have appropriate consent to contact your patients and leads via SMS and email, in compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any applicable state or local regulations.
  • Review AI-generated content: While Blue Sage uses AI to draft messages, you are responsible for reviewing and approving all content before it is sent to patients. You should not enable Auto approval mode until you are confident the AI drafts meet your standards.
  • Maintain accurate data: You are responsible for the accuracy of patient data synced from your booking system and any data you manually enter.
  • Comply with regulations: You are responsible for complying with all applicable healthcare, privacy, and marketing regulations, including HIPAA to the extent applicable to your practice.
  • Respect opt-outs: You must honor all patient opt-out requests. Blue Sage automatically processes STOP requests, but you must not attempt to circumvent these protections.
  • Use the Service lawfully: You must not use the Service to send spam, harass individuals, make false medical claims, or engage in any unlawful activity.

4. AI-Generated Content

Blue Sage uses artificial intelligence (powered by Anthropic's Claude) to draft patient messages, chatbot responses, and suggested replies. While we strive for accuracy and quality, AI-generated content may occasionally contain errors, inaccuracies, or inappropriate suggestions.

You are solely responsible for reviewing, editing, and approving all AI-generated content before it reaches patients. Blue Sage is not liable for any damages arising from AI-generated content that you approved and sent.

The approval system (Review, Guided, and Auto modes) exists to give you control over this process. We recommend starting in Review mode and only progressing to Guided or Auto mode after you have established confidence in the AI's output.

5. Messaging and Communication

The Service sends SMS messages via Twilio and emails via Resend on your behalf. By using these features, you agree to:

  • Comply with Twilio's Acceptable Use Policy and Messaging Policy
  • Comply with Resend's Terms of Service
  • Only send messages to individuals who have consented to receive them
  • Include accurate sender identification in all communications
  • Honor the send window restrictions (9 AM–7 PM in your local timezone)
  • Respect the per-patient message frequency limits enforced by the Service

SMS message and data rates may apply to message recipients. We are not responsible for carrier fees incurred by message recipients.

6. Chatbot Widget

The embeddable chatbot widget is intended for use on your own business website to capture leads and answer visitor questions. By embedding the widget, you agree to:

  • Inform website visitors that they are interacting with an AI chatbot, not a human
  • Include a link to your privacy policy on your website
  • Not use the chatbot to collect sensitive health information beyond general service interest
  • Comply with applicable data collection and privacy laws

7. Data Ownership

Your data belongs to you. You retain all ownership rights to your patient data, message content, templates, and business information. We do not claim ownership of any data you provide to the Service.

You grant us a limited, non-exclusive license to use your data solely to provide and improve the Service. We will not use your patient data to train AI models, sell to third parties, or for any purpose unrelated to providing the Service to you.

Upon cancellation of your account, you may request an export of your data. We will provide it in a standard machine-readable format within 30 days of the request.

8. Subscription and Payment

Blue Sage is offered as a monthly subscription. By subscribing, you agree to pay the applicable fees for your selected plan. Fees are billed monthly in advance via Stripe.

  • Free pilot: New customers may be eligible for a free pilot period. No credit card is required during the pilot.
  • Price changes: We will provide at least 30 days' notice of any price changes. Changes take effect at the start of the next billing cycle.
  • Refunds: We do not offer refunds for partial months. You may cancel at any time and your access will continue through the end of the current billing period.
  • SMS costs: SMS and email sending are included in all plans within standard usage limits. If your usage significantly exceeds typical volumes, we will work with you on a fair solution.

9. Cancellation

You may cancel your subscription at any time through the Service dashboard or by contacting us. Upon cancellation:

  • Your access continues through the end of the current billing period
  • All scheduled and pending messages are canceled and will not be sent
  • Your data is retained for 90 days to allow for reactivation, then permanently deleted
  • You may request immediate data deletion or data export at any time

10. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We will make reasonable efforts to notify you in advance of planned maintenance that may affect the Service.

11. Limitation of Liability

To the maximum extent permitted by law, Blue Sage shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of patients, loss of data, or business interruption, arising from your use of the Service.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold harmless Blue Sage, its officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Messages sent through the Service that you approved
  • Any claim by a third party related to your patient communications

13. Intellectual Property

The Service, including its design, features, code, documentation, and branding, is owned by Blue Sage and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

Message templates provided by Blue Sage are licensed for your use within the Service. AI-generated message content created for your patients is yours to use freely.

14. Third-Party Services

The Service integrates with third-party services including Twilio, Resend, Anthropic, Supabase, Stripe, and booking system providers. Your use of these integrations is subject to the respective third party's terms of service. We are not responsible for the availability, accuracy, or conduct of third-party services.

15. Modifications to the Terms

We may update these Terms from time to time. We will notify you of material changes via email or through a notice in the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Fairfield County, Connecticut.
